Child porn-case man 'poses grave risk to society'

SENTENCING of a man convicted of possessing child pornography has been adjourned by Judge Yvonne Murphy at Dublin Circuit Criminal Court to a date next year.

Anthony Luckwill (33) of Monastery Walk, Clondalkin, has been described by Judge Murphy as someone "who poses a grave risk to society".

Judge Murphy has also requested that his parents appear in court and said she wasn't prepared to release him back into the community without assurance of residential status.

She noted that Luckwill, who has admitted having a sexual interest in adolescent boys' underwear, had re-offended while on bail on this matter and had a conviction in another jurisdiction for similar offences to those before her.

Luckwill pleaded guilty to possession of nine images and three text files involving adolescent boys engaged in sexually explicit acts.

Judge Murphy adjourned sentence of Luckwill after being told that a medical report she requires will take more time to prepare.

Inspector Mary Delmar told prosecuting counsel, Vincent Heneghan, that Luckwill was extradited on February 17, 2005, from Wales where he resided while on bail for these charges. Insp Delmar also told Mr Heneghan that during the years Luckwill spent in Wales he was convicted and jailed for two similar offences there.

He was put under probation on July 13, 2003, for three years, having been charged with 16 counts of possession of indecent photographs of children.

Insp Delmar said Luckwill was jailed for 25 months on December 6, 2004, in Swansea and prohibited from using the internet or working with children for possession of similar pictures.

Defence counsel, Erwan Mill-Arden, told Judge Murphy that Luckwill has had a hard life. He was diagnosed with Asperger's Syndrome, a form of autism, at a very young age. He was ill-equipped to deal with life and had limited employment opportunities.

At a "very young age"?!? He was probably 19 before Asperger's was even accepted as a diagnosis.
Good point Ole. He could not possibly have been diagnosed with it at an early age.
I wonder if he was diagnosed with autism, and they altered his diagnosis when AS started to become well known.

Either way, its horrible that the defence point to AS as a major factor in these crimes, as there are so many stories of this type where a person is arrested in a crime relating to child porn, and 99.999% of them are NTs.
He may very well not have been diagnosed with anything at all - the defence may have claimed that the diagnosis was made at "a very young age" - that is to say many years ago - to explain why there is no longer any record of it in this person's medical notes.

In all probability, neither prosecutor, defence, nor judge, were aware that Asperger's is a relatively recent diagnostic concept, so it went unchallenged.

And he had a better start in life than many of us (being diagnosed early).

It is wrong to make excuses for something that is very wrong and against the law,especially when ASD has nothing to do with paedophilia.

I hate the way Lawyers will use any excuse to get a person freed.

Hold on isn't this the person who joined some NAS group in wales? Or am i thinking of someone else? Asked aload of aspie kids for pictures or something on research grounds then went back to Ireland when he got caught by a suspicious parent who was concerned by his requests.
I honestly wouldn't be suprised if in this case Aspergers did play a role, he exhibits all the signs of having a focused intrest in a very worrying subject, Aspies in general are some of the best people around, but occasionally you'll find one who's focus coincides with something dangerous.

The real problem is that there's not many positive cases in the Media, like maybe an Aspie's intrest in lifesaving techniques goes on to save someone's life, they focus on the tiny tiny deviant minority.
None of us knows more than is reported in the newspapers, which is no sort of basis for drawing conclusions about a case with any confidence.

What we do know from meticulously reported peer-reviewed medical research is that the prevalence of sexual offences amongst people with ASD is very low.

This is certainly not the first time a marginalized group has been falsely linked to sex offences - most recently, it was homosexuals who were the scapegoats.

Now that the gay community and their supporters have successfully dispelled this myth, the media and justice system have moved onto another marginalized and misunderstood group in search of a scapegoat.

Picking on Auts/Apsies would seem like a good plan, given what's believed by the public about the (apparent) communication issues - in their view, there's less chance that anyone will (rather is capable) of articulating another point of view.
