Our law firm serves as counsel to Bogus Corporation, owner of all intellectual property rights. It has come to our attention that you have made an unauthorized use of Bogus Corporation’s copyrighted work entitled Groceries List (the "Work"), first published in 1927 on their website. Your work entitled Grocery List clearly used the Work as its basis as evidenced by the copied sections of “eggs”, “milk”, “bread” “kumquats”.
As you neither asked for nor received permission to use the Work as the basis of your “Grocery List” nor to make or distribute copies including electronic copies, of same, I believe you have willfully infringed Bogus Corporation rights under 17 U.S.C. Section 101 et seq. and could be liable for statutory damages as high as $150,000 as set forth in Section 504©(2) therein.
Accordingly, Bogus Corporation hereby demands that you immediately cease the use and distribution of all infringing works derived from the Work, and all copies, including electronic copies, of same, and that you deliver to me, if applicable, all unused, undistributed copies of same, or destroy such copies immediately and that you desist from this or any other infringement of rights of Bogus Corporation in the future.
Bogus Corporation also requests that you immediately cease and desist from any facilitation of the use of its name, marks, or references to any food in any manner, and that you remove all references to eggs, milk, bread or kumquats from any website, power point presentation, seminar handouts, or any other promotional materials, including all records that may have been prepared in connection with visiting a grocery.
Bogus Corporation is filing a motion for preliminary and permanent injunctive relief to prevent your anticipated actions. Bogus Corporation is actively seeking a temporary restraining order and other injunctive relief in this matter. Failure to comply with these requests may expose you or your organization to an action for injunctive relief or monetary damages, and any other relief permitted under state and federal law, including court costs and attorneys' fees. You may also wish to consider and examine the potential criminal consequences, under theories of aiding and abetting and conspiracy, if you facilitate family members in composing your Grocery List.
If I have not received an affirmative response from you in 2 weeks, indicating that you have fully complied with these requirements, Bogus Corporation will take further action against you and proceed in a manner appropriate to protect its valuable intellectual property rights.
